Courts have been expanding the concept of “functional equivalent of privity” which presents serious new risks (at least in New York) for engineering firms who, in the past, only needed to be concerned about claims passed through architects. Robert A. Banner, partner in Ingram’s construction & design group, will present a seminar at the ACEC 2019 Tri-State Conference that will explain these risks and identify strategies for engineering firms to avoid direct exposure to owners and even contractors. Moreover, he’ll highlight the risks of engineering firms not aligning their contractual dispute mechanisms with architects or their own sub-consultants and offer strategies that can improve engineering practices relative to minimizing risk, particularly as they relate to claims and lawsuits.
